By downloading, accessing, or using Hypnofly—including its self-healing hypnosis recordings, articles, parenting oracle cards, daily affirmations, and other features—you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of the App.

2. Purpose of the App

Hypnofly is designed to support relaxation, mindfulness, and self-healing, helping users cultivate a calm, balanced, and empowered approach to parenting and personal growth.

The App does not provide medical, psychological, or professional therapeutic services and should not be used as a substitute for professional healthcare advice or treatment.

3. Use of Self-Healing Hypnosis Recordings

To ensure a safe and effective experience, follow these guidelines:

Optimal Listening Conditions

• Use headphones or earbuds to enhance immersion and minimize external distractions.
• Listen in a quiet, safe environment where your attention is not required elsewhere.
• Ensure children and dependents are supervised before starting a session.

Safety Precautions

• Do not listen to hypnosis recordings while driving, operating machinery, or engaging in activities requiring full attention.
• If using wired headphones, ensure cords are safely tucked away to prevent accidents.

Medical Considerations

• If you are taking medication or have a diagnosed mental health condition, consult a healthcare provider before using hypnosis recordings.
• The App does not diagnose, treat, or cure any medical, psychological, or emotional conditions. If you need professional support, seek guidance from a qualified healthcare provider.

Immersion & Effectiveness

• For best results, listen with eyes closed and allow full mental immersion.
• Regular use of self-healing hypnosis recordings can support behavior and mindset shifts. Consistency is key.

4. Disclaimer

• The creators and distributors of Hypnofly make no guarantees regarding health, emotional well-being, or personal transformation.
• No liability is assumed for any direct, indirect, incidental, or consequential outcomes resulting from the use of Hypnofly.

5. Subscription and In-App Purchases

Hypnofly offers paid subscriptions and in-app purchases through Apple’s App Store.

• Payments are processed securely through Apple.
• Subscription plans automatically renew unless canceled at least 24 hours before the renewal date.
• To manage or cancel a subscription, users must do so directly through Apple’s App Store settings.
• Refunds and billing disputes are subject to Apple’s policies, and Hypnofly does not provide direct refunds.

6. Intellectual Property

All content within Hypnofly—including self-healing hypnosis recordings, articles, parenting oracle cards, affirmations, branding, logos, software, and other materials—is protected by copyright, trademark, and intellectual property laws.

You may not:

• Copy, modify, distribute, or publicly display any content without prior written consent.
• Reverse-engineer, resell, or exploit any part of the App or its content for commercial purposes.

Unauthorized use of Hypnofly’s intellectual property may result in legal action.

7. Limitation of Liability

Hypnofly is provided “as is” and without warranties of any kind, either express or implied.

To the fullest extent permitted by law:

• Hypnofly and its affiliates disclaim all warranties, including fitness for a particular purpose, non-infringement, and uninterrupted service.

• Distribute unauthorized copies or share login credentials.

Continued use of Hypnofly after updates constitutes acceptance of the revised Terms.

• We do not control third-party policies, content, or practices.
• Use of third-party services is at your own risk, and their respective Terms of Service and Privacy Policies apply.

We are not responsible for any losses, damages, or liabilities arising from interactions with third-party platforms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws principles.

• Any disputes arising from these Terms or the use of Hypnofly shall be resolved through binding arbitration in San Francisco, California, except for claims eligible for small claims court.
• You waive the right to a trial by jury or class-action lawsuit.

If any provision of these Terms is found to be unenforceable, the remainder of the Terms shall remain in full force and effect.
